Data Protection and Privacy Policy (As of: May 2018)

Data protection enjoys a particular high priority at R.I. Vermögensbetreuung AG (RIV). It is important to us that you know which personal data we collect, transmit, process and use and for which purpose we do this. The following data protection statement complies with the General Data Protection Regulation of the European Union (In German: EU-Datenschutzgrundverordnung – DSGVO) as well as the German data protection law (In German: Bundesdatenschutzgesetz – BDSG-2018). The data protection statement provides an overview of type, purpose and use of personal data that is obtained by us while visiting our website and of the organization of our data protection within our company. This way we would like to put you in the position to safeguard your fundamental right of informational self-determination. Please keep in mind that this is a translation from our data protection statement in German language. In case of any ambiguity please refer to the German data proection statement.

The responsible supervisory authority for data protection is the „Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg“.

Data Security

When accessing our website, a SSL-encryption is used. The encryption is active if the symbol of a lock can be seen in the browser line. The relevant browsing line then starts with https://. The SSL-encryption prevents thirs parties from accessing data that is transmitted between the server of the website and your internetbrowser.

Furthermore, we are careful to implement current technical and operational measures to secure your data against loss, accidental or intentional manipulation, destruction as well as unauthorized access by thirs parties or unauthorized transmission.

Collection and Processing of Personal Data

Personal Data in form of online data is generally only collected to an extent which is technically necessary. The functionality of our website requires these data of website visitors. As certain online data are identifiable data, which under certain circumstances unambigously can idenfify a natural person, these online data must be particularly proceted.

Every access to the website of RIV triggers an automatic collection and recording of general data and information, amongst others online data.

In doing so, personal data from website visitors are collected in the form of the Internet-Protocoll-Address (IP-Adress), which however is anonymized immediately.

Beyond that the following general data and information is collected from website visitors:

  • Browsertype and sersion
  • Operating system
  • Referrer-URL
  • Directly accessed subpages of the website
  • Date and time of access
  • Internet-Service-Provider
  • other similar data and information.

These general data and information are automatically anonymized by the hosting company of the website in logfiles of the website server and stored for 9 weeks at most.

RIV does not draw any conclusions about the identity of website visitors when using these personal data as well as the general data and information. The information is exclusively used to ensure a problem-free connection to the website, to ensure the proper display of content on our website, to ensure an optimization of the content on our website as well as advertising of our website as well as to ensure the sustained functionality of our IT-systems and technology powering our website. In addition these anonymously collected general data and information are analyzed by RIV statistically and for the purpose of improving data protection and data security to provide a higher level of saftey for the processed personal data.

Apart from the already mentioned personal data, other personal data are only collected and stored if these are provided by you voluntarily by another means of communication than our website, e.g. in the course of a request via e-mail. In the case that you have transmitted or communicated personal data to RIV, we will exclusively use these personal data to answer your request. Your personal data are only transmitted to third parties or others if this is necessary for the purpose of fulfilling a order given by you or in the course of an already existant contractual relationship or if you have given your explicit consent or there are legal requirements which allow us or mandate us to share information, e.g. with law enforcement authorities. Should it come to an initiation of a contracatial relationship or should it come to a contractual relationship between RIV and you, then RIV will inform you about its approach to data protection related issues within the contractual relationship in written form.

Personal data are only used and stored for the period of time which is needed to achieve the purpose of storing data and provided that it is allowed under European regulators or another regulatory body which RIV is subjected to.

If the purpose of storing data is no more or if the required retention period by European regulators or another regulatory body has ended, then personal data is routinely blocked or deleted according to the regulations.

In no case will data be sold to third parties. In general no data will be transmitted or conveyed to third paries. The transmissions resulting from cookies and web services are explained below. Through measures and routinely controlls described in the point data security, we ensure that third parties to not get access tot he collected personal or tap into it.

Generally, we do not transmit data abroad or to supranational or intergovernmental authorities. A transmission of data merely takes place into the USA by using Google Analytics and Google Maps. Further information on this can be found in the following points.

Cookies

We use cookies on our website. By using cookies, RIV is able to provide website visitors with a more user-friendly, a more effective and a more secure visiting experience which would not be possible without cookies. Cookies are Text-Files which are stored on the computer system of the website visitor. The cookies we set on your computer system do not cause any damage and do not contain any computer viruses. Cookies may contain different information, which often match the previously mentioned general data and information. In addition cookies my contain so-called cookie-IDs, which are an unambigous identification of the cookie. This allows for visited websites and servers to distinguish between differend browsers of different website visitors. Beyond this, temporary session-cookies might be used which automatically are deleted when the website visitor leaves the website and closes the browser or automatically are deleted on the server. Visitors of our website can prevent cookies from being set by applying the respective settings in the internet browser. This is possible in all common internet browsers. Information on how to change the settings are usually found in the help function of the browsers. If you do not want to accept any cookies, even session-cookies, the help function of the browser also helps to explain how the broser can be set to not accept any new cookies when visiting websites. A lot of browsers can also be set to automatically inform you if a new cookie was set. The help function of your browser usually also explains how to delete cookies which already are set. Some browsers are able to only allow certain cookies from certain website to be set. If cookies are disabled, some functions of our website may not be able to be used fully.

Usage of Webservices

By using webservices, RIV is able to optimize the user experience for website visitors. By no means will data from these webservices be used to draw conclusions about the identity of persons.

  • Google Analytics

This website uses Google Analytics, a webanalytics service by Google Inc. („Google“), 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

Google Analytics uses cookies enable an appropriate design and continuous optimization of our website by analysing the flow of website visitors. Beyond that the function „demographic characteristics“ from Google Analytics is used. This allows fort he creation of reports that make statements on age, gender and interests oft he website visitors. This data originates from interest-related advertising by Google as well as from data on the website visitors from third parties. These data cannot be used to draw conclusions about the identity of persons. You can disable this function at any time in the advertisement settings in your Google Account or generally prohibit the collection of your data by Google Analytics, as detailed later on.

Information generated by the cookie about your interaction with this website is usually transferred to and stored on a Google server located in the US. The IP address conveyed by your browser within the context of Google Analytics will not be linked to any other Google data. This website has been supplemented by the code “gat._anonymizeIp();”. This ensures the masking of your IP-Address, such that all data is collected anonymously. The complete IP address is only transferred to a Google server in the US and abbreviated there in exceptional cases. On behalf of the operator of this website, Google will use this information to measure your interaction with the website, compile reports about website activities for their operators and provide other services related to the use of the website and of the Internet. You may refuse the use of cookies by selecting the appropriate settings on your browser, we would point out, however, that you can optionally use to their full extent in this case not all features of this website. You can also prevent the data generated by the cookie about your use of the website (including your IP address) to Google and the processing of these data by Google, by downloading the following link browser plugin and installing it (https://tools.google.com/dlpage/gaoptout?hl=en).   • Google Maps Plugin

On our website we use an API of the mapping webservice Google Maps. Google Maps is used to let the offices of R.I. Vermögensbetreuung AG be found by website visitors in an easy manner. Google Maps is operated by Google Inc., located in the USA, CA 94043, 1600 Amphitheatre Parkway, Mountain View. By using Google Maps on our website, information about your usage of the website and your IP-Address will be transmitted to a Google server in the USA and stored there. Possibly your location data will be transmitted, but this will not happen without the consent of website visitors, e.g. with mobile devices in the app-settings or -authorizations. We do not have any knowledge of the precise content of the transferred data, nor of your use of Google. Within this context, Google denies that data and infomration is connected to other Google services or personal data. However, Google may transmit data to third parties. If you deactivate Javascript in your browser, you will prevent Google Maps from being launched. You will however then not be able to use the mapping service on our website. Rights of Website Visitors

When visiting our website you are entitled to data procetion rights. You can contact RIV or the data protection officer at any time to claim and implement these rights without any cost to you.

  • Right to obtain confirmation

You have the right to obtain a confirmation from the responsible body about your personal data that is processed.

  • Right of access

You have the right to receive access to your personal data and or copies or this data, which was processed by RIV. This includes information on the purpose of the use, the category of the used data, the recipients, who was authorited to access this data as well as – if possible – the planned duration of the storage of the data or – if not possible – the criteria that determine the duration of storage.

  • Right to demand correction

You have the right to demand the immediate correction of false personal data concerning you. Taking into account the purpose of the use, you have the right to have incomplete personal data completed, also via supplement.

  • Right of erasure

You have the right to demand the immediate erasure of personal data concerning you and RIV is obliged to immediately erase this date, if one of the following reasons applies:

  • The personal data is not any longer needed for those purposes for which they were collected or processed
  • You appeal the processing of the data, as there are no urgent justified reasons
  • The personal data was process illegally.
  • The erasure of personal data is demanded by legal obligations under regulations of the European Union or a member state which RIV is subjected to.

This does not apply if the processing:

  • is demanded by legal obligations under regulations of the European Union or a member state which RIV is subjected to.
  • is required to enforce, exercise or defend itself from legal claims.
  • Right to limitation of data processing

You have the right to demand the limitation of data processing, if the following requirements are given:

  • you contest the accuracy of your personal data for a duration that allows RIV to prove the data;
  • the data processing is illegal and you reject to the erasure of the personal data and instead demand a limitation of the processing of the personal data;
  • RIV does not require the personal data for the purpose of processing, it however requires it to enforce, exercise or defend itself from legal claims, or
  • You have appealed the processing and no decision has been made on who has more justifiable reasons.

If the data processing has been limited, then the personal data may only be used – with the exception of storing them – with your consent, to enforce, exercise or defend RIV from legal claims or to safeguard the rights of a natural or legal person or due to reasons important to the public interest of the European Union or a member state. If you have obtained a limitation of the data processing, RIV will inform you before the limitation is lifted.

  • Right to data portability

You have the right to receive any personal data concerning you in a common structured and machine-readable format, as far as his is technically feasible. Beyond that you have the right, according to Art. 20 Abs. 1 DSGVO, to have the personal data transmitted directly to a body of your chosing, as far as this is technically feasable and no rights of other persons are infringed upon.

  • Right of appeal

As far as the data processing of personal data takes place due to Art. 6 Abs 1 (f) DSGVO, you have the right to appeal the data processing at any time due to your personal circumstances. RIV will then not process these personal data any longer, with the exception if legitimate grounds can be proven that exceed your interest, rights and freedom or to enforce, exercise or defend itself from legal claims.

  • Right of withdrawal

If the data processing is based on your consent, you have the right to withdraw this consent at any time without the legitimacy of the data processing being affected because of the consent of withdrawal.

  • Right of complaint

You have the right to file a complaint with the supervisory authority irrespective other administrative or legal judicial remedies if in your view the processing of the personal data concerning you is in violation of DSGVO.

No automated decisions or profiling

As a responsible company, we do not apply automated decision making or profiling.

Changes to the data protection statement

RIV retains the right to change the data protection statement at any time in accordance with current data protection regulation. The legal framework concerning data protection is, as experience shows, under constant change, to which our privacy policy has to adapt to if necessary. Likewise is the content of our website subject to change and further development. We therefore retain the right to adapt this current privacy policy.

Severability clause

If for any reason any of the above conditionsshould become invalid, this shall not affect the other conditions.
